Communication in accordance with article 13 of the Italian Legislative Decree n. 196 of the 30th June 2003 and declaration of informed consent

Holden S.r.l, based in Turin, Piazza Borgo Dora n. 49, 10152, the data controller, will process, in accordance with the Legislative Decree 196/2003, the personal data supplied at the user’s registration on the website at the addresses and (“Site”), as well as any data that will successively and eventually be supplied by the user on the Site, also following the acquisition of goods and/or during the participation of events organised by Holden S.r.l. The processing will mainly occur electronically or, however, by employees and collaborators of Holden S.r.l and the data will be inserted into Holden S.r.l’s digital database, to allow the management of our accounting, of collections and payments, the emission of fiscal documents, the management of orders, the management of relative contracts, the elaboration of internal statistics, the dispatch of commercial and informative communications and promotional and advertising materials, to the data subject’s email address as well. The data can be communicated by Holden S.r.l to couriers and carriers for the delivery of goods to the data subject or to third parties indicated by the subject or, in any case, to third parties involved in the execution of agreements of goods and/or services supply, in regards to the actions necessary for its execution. Holden S.r.l does not take responsibility with regards to personal data that has not been directly communicated by the data subject, which will however be processed in accordance with the Legislative Decree 196/2003.

The data subject chooses freely to give his/her information: were he/she to choose to not give it, the data subject will however not be able to register on the Site and, therefore, not access the activities and/or services allowed to registered users (such as the acquisition of goods), nor will the purposes described above be possible.

The data holder has, in particular, the rights described in art. 7 of the Legislative Decree 196/2003, “Right to Access Personal Data and Other Rights”, here quoted in the formulation that is presently in force.

“1. The data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.

2. The data subject shall have the right to be informed 

a) of the source of the personal data; 

b) of the purposes and methods of the processing; 

c) of the logic applied to the processing, if the latter is carried out with the help of electronic means; 

d) of the identification data concerning data controller, data processors and the 

representative designated as per Section 5(2); 

e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

3. The data subject shall have the right to obtain 

a) updating, rectification or, where interested therein, integration of the data; 

b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; 

c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 

4. The data subject shall have the right to object, in whole or in part, 

a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; 

b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.”
